Mediation is a way for the parties in a dispute to come to an agreement without going through litigation.
Mediation is overseen by a neutral mediator who guides communication between the two parties. The goal is to have a constructive conversation about your concerns, with a focus on finding solutions.
Mediation can be a less expensive alternative to litigation through the courts. In a trial, the judge or jury makes a final decision– in mediation, you are the decision-maker. The focus isn’t on winning or losing. You may not get 100% of what you want, but a mediator can help you explore creative solutions and come to an agreement you can live with.
Once the parties have reached an agreement, it must be put into writing and signed. The final agreement is legally binding and can be enforced by the court.
A mediator cannot provide counseling, legal or business advice. Rather, the mediator is there to help you focus on resolving your dispute. A mediator has met many requirements in order to be certified by the Florida Supreme Court, and they are bound by professional ethical standards.
